These Terms and Conditions ("Agreement") apply to any orders placed on the website Bloomsnberrys.com, which is owned and operated by M/S Casa Florista, a company registered with the Government of Rajasthan. By using this website, you agree to the following terms and conditions.

1. Delivery Time Frames

All same-day orders must be placed by 5 p.m. on the same day. Orders placed after this time will be considered for delivery the next day. We do not promise any timed deliveries; our standard delivery hours are from 9:00 a.m. to 9:00 p.m. Clients can request a specific delivery time in the Special Instructions area of the payment form; we will do our best to accommodate the request, but we cannot guarantee 100% efficiency.

Delivery times, if promised, are not guaranteed in the event of unusual situations such as harsh weather, riots, strikes, elections, bandhs, or rush days like Valentine's Day, Mother's Day, Rakhi, New Year's Eve, etc. Cancellation is not possible in such circumstances.

For Valentine Midnight delivery, the delivery will occur between 10 p.m. and 1 a.m.

2. Discounts

Bloomsnberrys determines all discounts, and no discounts or offers may be combined.

3. Address Alterations

Any modifications to the recipient's address can be made free of charge if requested at least 48 hours before the actual delivery. Changes made after this time will not be accepted, and the order cannot be canceled. After the product is shipped, it is not possible to change the address for gift category items.

4. Order Alterations

Order modifications can be made with monetary adjustments if requested at least 48 hours before the scheduled delivery. After this time, no changes will be accepted, and the order cannot be canceled. A 5% cancellation fee applies to all cancellation requests.

5. Shipping Products

Due to differences in suppliers and seasonal limitations, floral arrangements may not exactly replicate those displayed on the website. The quantity of goods will remain constant, but substitutions made due to product availability will be of equal or greater quality. Variations in flower color or cake style may occur due to regional availability.

6. Grievances

Any complaints about the items supplied should be reported within 24 hours of delivery. Customers must report the issue via phone, WhatsApp, or email to customer support.

7. Regulations for Delivery

Delivery will be done according to the instructions provided. If the instructions specify delivery to the recipient only, the order will not be delivered to anyone else and will be considered delivered if the recipient is unavailable. If the recipient declines the delivery, we will consider the order delivered.

Bloomsnberrys can only attempt delivery once. If the delivery attempt fails, the customer will still be charged, and redelivery will not be available. Orders will be considered delivered under the following circumstances:

  • Incorrect shipping/delivery address.
  • The recipient is unavailable.
  • The premises are locked.
  • Incorrect contact details (landlines, mobile numbers, or extension numbers).
  • The recipient declines to accept the delivery.
  • The shipment is delivered to the gate/reception/neighbor.

8. Replacement Policy

Due to regional supply concerns, flower arrangements or containers may be substituted. The design, theme, and color scheme will be maintained, and only products of equal or greater value will be substituted. We reserve the right to substitute flowers (including their color) with other items of equal or greater value if the original product is unavailable.

9. Rules for Duplicate Orders

If Bloomsnberrys identifies that a duplicate order has been placed, we will attempt to contact the client for confirmation. If the client is unreachable, the final decision will be made by Bloomsnberrys.

10. Handling Fraudulent Clients

We reserve the right to refuse an order or block a customer without providing an explanation if fraudulent activity is detected, such as the use of incorrect addresses, unethical messages, strange delivery requests, or any other suspicious activities.

11. Guidelines for Unavailable Recipients

If the intended recipient is unavailable to accept the delivery, the purchase will be considered delivered, and no refund will be provided. For more details, please refer to our Cancellation and Refund Policy.

12. Courier Shipments

Courier products will be shipped via BlueDart or a comparable courier service. We cannot provide specific delivery dates or times. Deliveries will occur between 9 a.m. and 7 p.m. and may take 3 to 9 days depending on product availability and other factors.

13. Service Availability

Our services are available to any individual, group, company, or business unit. We reserve the right to refuse service to any person or entity at our discretion and will not be held liable for such actions.

14. Amendments to Terms and Conditions

Bloomsnberrys reserves the right to periodically update these terms and conditions. These agreements shall be governed by Indian law, and Jaipur courts shall have exclusive jurisdiction over any disputes arising from them.

15. Entire Agreement

These terms and conditions, along with Bloomsnberrys' Cancellation and Refund Policy, Privacy Policy, Disclaimer, and other rules posted on the site, constitute the entire agreement between you and Bloomsnberrys. We retain all rights not specifically granted in these terms and conditions.

16. Promotional Communications

By using this website, you agree that Bloomsnberrys may use your registered email address and phone number to send transactional and promotional communications, including SMS, calls, WhatsApp, RCS, and emails.

17. Quality Assurance

Bloomsnberrys strives to deliver the highest quality products and services. In order to maintain quality, we may contact the recipient for feedback on their experience.

18. Fraudulent Orders

If any unethical order is placed, Bloomsnberrys considers this fraudulent activity. The company reserves the right to collaborate with law enforcement authorities and take necessary actions, including notifying the police or relevant authorities.

19. Account Closure

If you wish to close your account, please send an email with the subject "Closure" to our support team. After confirmation, your account will be deactivated, and you will no longer have access to your account history, information, or communication from Bloomsnberrys. The account will be deleted within 30 days unless you contact us to prevent deletion within this period.
